How to Prevent a Work-Related Back Injury

As you probably already know, back injuries are one of the most common work-related injuries you can suffer while at work. Back injuries can have life altering ramifications and can make it hard to just get through the day.  There are things you can do to help prevent a work-related back injury.

Stretching and strengthening exercises can help improve muscles, reducing the chances of a back injury.  Paying attention to your posture is also key. Poor posture can increase the stress level on your back leading to an injury.  When picking up objects, whether they are light or heavy, you should always lift the right way. Always make sure that your legs are doing most of the work while lifting, not your back.

Do You Have Carpal Tunnel Syndrome?

Imagine sitting at work and being unable to type on the keyboard because your hands and wrists hurt too much. This painful scenario can be caused by a condition known as carpal tunnel syndrome.

However, typing may not be the only cause. Many assembly line workers and employees that have jobs that require repetitive activity can also suffer from this condition. Long hours of typing without rest and activities that require repetitive flexing and extending of the tendons for long periods of time can lead to carpal tunnel syndrome.

Carpal tunnel syndrome is caused when a key nerve in the wrist becomes compressed causing excruciating pain. The symptoms generally start with pain, weakness or numbness in the hand area. The pain can generally be felt up the arm and accompanied with a tingling sensation during the day. The good news is, if properly treated, most people who suffer from the condition fully recover.

Florida injured workers must report the injury within 30 days

Florida's Workers' Compensation laws provide lost wages and medical care for those who are injured in the course and scope of their employment.  However, in order to preserve your rights to these benefits, you must notify your employer within 30 days of the injury.  Notification can be done verbally or in writing to anyone in a supervisory capacity.  I am often amazed when I hear an injured worker's case has been denied because they waited a few days to report the injury.  I hear all types of reasons for delaying the initial report..."It was the weekend"; "I thought I would get better"; "I didn't want to jeopardize my job".  The point is, it doesn't matter!  As long as notice is given within 30 days, the legal requirement has been met. No reason need be given for the delay and an employer cannot deny benefits on this basis, regardless of whether the "company" policy requires immediate reporting.  A company's policy cannot trump Florida law.

Florida Workers’ Compensation Facts

If you have sustained a Florida work injury or have become ill from your job, you may be entitled to benefits under workers’ compensation.  Workers’ compensation, also referred to as workers’ comp, is a type of insurance that allows you to obtain medical care and compensation for lost wages.

In Florida, an employer within the construction industry who has more than one employee is required to obtain workers’ compensation insurance, even if the employer is out-of-state.  In non-construction industries, any employer who has four or more part or full-time employees must have this coverage. 

As an injured worker, you are entitled to medical benefits that include doctor’s visits, hospitalization, physical therapy, medical exams, prescriptions and other authorized medical expenses.  You are also entitled to compensation for your lost wages, which is usually equal to 66 2/3% of your average weekly income.  This compensation is meant to help you financially while you recover from your work injuries.

There are other Florida workers’ comp benefits, such as impairment benefits, permanent total disability benefits and death benefits.

Filing a workers' comp claim in a bad economy

Florida's New Workers' Compensation law

An amended version of Florida's Workers' Compensation law goes into effect today. Florida's Legislature in their infinite wisdom (or more appropriately, lack therof) has seen fit to essentially eliminate insurance company paid attorneys fees for lawyers representing injured workers. This is a big victory for the insurance industry which convinced our politicians that they were in need of further bail out at the expense of Florida's workers. The new law will make it harder for injured workers in Daytona Beach, as well as the entire state, to obtain benefits if they are injured on the job. However, injured workers in our area can rest assured that Johnson & Gilbert will continue to fight to obtain benefits to which you are entitled.
