At a recent Social Security Disability hearing in Daytona Beach, FL my client was alleging disability based on a variety of physical problems. However, my client had a semi-skilled work background with some transferable skills.  Based on the skill level, and her physcial complaints alone, she was not going to be found disabled.  However, she was also alleging depression and was taking medication through her primary care physician.  Although she was not treating with a psychiatrist, a mental health care evaluation was the key to winning the case.  It turned out that since she was depressed, the mental health care professional gave an opinion that she could work, but only in jobs with routine, simple task.  This fact allowed a finding of disability because she was unable to perform semi-skilled work.  Therefore, if you are alleging depression as a component of your Social Security claim, it is important to discuss with your doctor how the depression effects your ability to perform task.  If you have questions regarding your claim for Social Security, please contact our office at 1-800-556-8890 for a free consultation.
